Terms and Conditions.
Introduction
These terms and conditions govern the provision of gardening and outdoor maintenance services by Compton Garden Services to our clients. By engaging our services, you agree to be bound by these terms and conditions. These terms are designed to ensure clarity and fairness between us and you.
Scope of Services
We offer a wide range of services, which may include but are not limited to:
Grass cutting, strimming, edging and lawn treatment
Hedge trimming and shrub maintenance
Weeding, mulching and planting
Tree pruning and minor tree work (not involving climbing or large-scale removal)
Pressure washing of outdoor surfaces
Fence repairs and outdoor painting
Seasonal garden clearance and general garden tidy-ups
Ongoing garden maintenance contracts (weekly, fortnightly or monthly)
All services will be outlined and agreed upon in advance, either through a written estimate or service agreement.
Estimates
Validity of Estimate
All estimates provided by Compton Garden Services are valid for a period of 30 days from the date of issue. If work is scheduled to commence after this period, Compton Garden Services reserves the right to reassess and revise the estimate to reflect any changes in conditions or additional work required.
Change in Scope Due to Time Lapse
If there is a significant delay between the acceptance of the estimate and the commencement of work, and if the scope of the work has increased due to changes in garden conditions (e.g., growth, weather impact or neglect), Compton Garden Services will inform the client of the additional work required and any resulting changes in cost before commencing the job.
Additional work will not be carried out without the client's approval of the revised estimate.
Right to Revise the Estimate
In circumstances where the job conditions have changed substantially, Compton Garden Services reserves the right to revise an estimate for the job or decline to carry out the work if it exceeds the originally agreed terms.
Bookings, Cancellations and Rescheduling
Bookings are confirmed in writing or via email.
A minimum of 48 hours' notice is required to cancel or reschedule an appointment.
Cancellations within 24 hours may incur a charge of 50% of the scheduled fee.
We reserve the right to reschedule or cancel due to adverse weather conditions, equipment failure or health and safety concerns.
Recurring services may be paused or amended upon request, with reasonable notice.
Site Access and Preparation
You are responsible for ensuring clear and safe access to the property and work areas.
Please secure pets, unlock gates, and remove obstacles before our arrival.
If access is not possible, we reserve the right to charge a call-out fee.
Health and Safety
Compton Garden Services complies with all applicable health and safety legislation.
Our team is trained in the safe use of gardening tools and machinery.
We reserve the right to refuse work where we deem conditions to be unsafe, such as excessive slope, hazardous materials, or restricted visibility.
Environmental Policy
We aim to reduce waste and promote environmentally friendly practices wherever possible.
We encourage composting and responsible green waste disposal.
We avoid the use of chemical treatments unless specifically requested and agreed upon in writing.
Materials and Waste Disposal
Materials purchased by us for your job will remain our property until full payment is received. All waste generated will be left in an agreed location unless a green waste removal service is arranged in advance (charged separately).
Hazardous waste (e.g. Japanese knotweed, asbestos or contaminated soil) is not handled and should be managed by a licensed contractor.
Subcontractors
Occasionally, we may use trusted subcontractors to carry out certain works.
Subcontractors are expected to uphold the same standards as Compton Garden Services.
You will be notified in advance if a subcontractor is to be used.
Payment Terms
Payment is due within 7 calendar days of the invoice date, unless otherwise agreed.
Accepted payment methods include bank transfer, cash or other electronic means.
Late payments may incur interest at 4% above the Bank of England base rate.
Persistent late payment may result in termination of services and legal recovery action.
Warranties and Guarantees
We guarantee our workmanship for 7 days after the completion of a job.
This guarantee does not cover damage caused by weather, pets, pests, or third-party interference.
Any concerns or complaints should be raised within 48 hours of service completion.
Liability
We carry full public liability insurance.
We are not liable for any pre-existing damage or faults on site.
We are not liable for underground services (e.g. irrigation, cables, pipes) not disclosed in writing before work begins.
We accept no responsibility for damage caused by equipment used in areas not suitable or not prepared correctly.
Data Protection
We are committed to protecting your personal data.
Information collected will only be used for service delivery, communication and invoicing.
Your data will not be shared with third parties without your permission, except where legally required.
Termination of Services
Either party may terminate a maintenance agreement with 14 days' written notice.
In the event of a breach of these terms, we reserve the right to terminate services immediately.
Force Majeure
We shall not be liable for any delay or failure to perform our services due to events beyond our control, including but not limited to acts of God, extreme weather, accidents, illness or government restrictions.
Governing Law
These terms and conditions shall be governed and interpreted in accordance with the laws of
England and Wales. Disputes shall be subject to the jurisdiction of the English courts.
